INTRODUCTION

Receptiviti Inc. is a Canadian psychology-based language analysis platform (“Receptiviti”, “we”, “us”). Receptiviti has developed technology that analyzes natural language to evaluate human emotion, personality, and aspects of psychology. Receptiviti’s platform can be accessed through local or cloud-based Application Program Interfaces (“APIs”) and may consist of other interfaces that enable assessment of language samples (together, the “Services”). 

Your privacy is very important to us, which is why we collect and process as little of your Personal Information (defined below) as possible. This Privacy Policy describes how we collect, use, disclose, store and protect your Personal Information. It also describes the rights you have regarding your Personal Information. This policy governs the use of our website https://www.receptiviti.com/ at (the “Website”) and your use of our Services.  

This Privacy Policy should be read together with our Terms of Use and API Agreement. Any capitalized terms used but not defined in this Privacy Policy have the meaning ascribed to them in our Terms of Use and/or API Agreement. If you do not agree with the terms of this Privacy Policy, please do not access or use the Website or Services. WHAT IS PERSONAL INFORMATION?

Personal Information is information that, alone or when combined with other information, can identify you. When you share your Personal Information with Receptiviti, such as your name, language sample, or email address, for example, this is information we are collecting and processing about you.

TYPES OF PERSONAL INFORMATION COLLECTED BY RECEPTIVITI AND PURPOSE FOR COLLECTION

Receptiviti collects Personal Information through our Website and Services. To help you understand what information we collect, we identify categories and types of Personal Information per service.

Website User

If you are simply using the Website, Receptiviti may collect the following Personal Information:

  • Account Data, such as your email address and password, if applicable. 

    • We collect this information to register and administer your account with Receptiviti.

  • Company Data, such as your company name, email address, and the Receptiviti products or services of interest to your company, and billing information, as applicable. 

    • We collect this information to connect you with one of our experts to discuss our products and services and, if applicable, to open a new account or administer an existing account.

  • Opinion Data, such as free text boxes where you may submit information about your areas of interest. 

    • We collect this information to enable you to share specifics about your interests in Receptiviti products and services and to help us to connect you with one of our experts, ready to address your questions.

  • Browsing Data, such as the Website pages you visited, the time spent on each Website page, the products or services you viewed or searched on the Website, Website page response times, Website downloads and download errors, and methods used to browse away from the Website. 

    • We collect this information for technical quality improvement of our Website and to troubleshoot any technical errors. We also collect this information to better understand how our existing and prospective customers are interacting with our content.

  • Technical Data, such as location, time-zone setting network information, device type, browser type and version, browser plug-in types and version, operating system and platform, language, standard web log data, and IP address used to connect your computer to the Internet or other similar identifier, or the equipment you use to access or use the Platform and usage details. 

    • We collect this information for troubleshooting technical errors, improving the functionality of our Website, enhancing the accessibility of our Website, understanding where our existing and prospective clients are located. 

Some areas of the website allow you to enter your email address for purposes including, but not limited to, inquiring for help or information, downloading a case study, and access to our services. You may unsubscribe at any time from receiving email messages from us by clicking on the “Unsubscribe” link contained in any email.

 

API User

If you are using our API, Receptiviti collects the following information:

 

API administered locally by customer: Receptiviti does not collect any Personal Information.

 

API administered by Receptiviti in the Cloud: Receptiviti collects the language sample you submit for analysis, the company’s IP address, and the unique ID associated with a language sample (generated and provided by you).

  • We collect this information for the purpose of assessing the language sample and producing our analysis in an anonymized report. The report is provided to you, our enterprise customer, only. Receptiviti only retains the language sample for a few seconds while it is being analyzed, after which the sample is immediately, automatically and permanently deleted. 

 

Applications

Receptiviti may offer various Applications, such as an Assessment tool in which enterprise customers may sign up for a short language assessment questionnaire that is designed and analyzed by Receptiviti (the “Assessment”). Through Applications like the Assessment, Receptiviti collects, processes and stores, responses to the Assessment. Receptiviti may use this anonymized data for the purpose of quality improvement, algorithmic training, and business intelligence reports. The Assessment does not and cannot identify any individual respondent. 

SOURCES OF PERSONAL INFORMATION

Receptiviti takes steps to ensure that any Personal Information we collect is adequate for, relevant to, and aligned with the uses of such Personal Information, as described in this Privacy Policy. We collect information about you from the following sources:

Information Provided to Receptiviti by You

Personal Information that Receptiviti collects from you on or through the Website or Services may include Personal Information you provide Receptiviti directly, for example by:

  • submitting, posting, publishing, displaying, or otherwise transmitting User Generated Content (or, content that you create and choose to share);

  • filling in forms, making search queries, or corresponding with Receptiviti on or through the Website or Services, or otherwise communicating with Receptiviti by any means including by phone or email; or 

  • as applicable or available through or on the Website or Services: creating or registering for an account; subscribing, purchasing, or requesting information on a service or product; or entering a contest or promotion. 

 

Information Collected by Receptiviti Through Technological Means

Receptiviti may also use cookies or similar automated technologies to collect Browsing Data or Technical Data. Cookies are small text files that are placed on your computer or mobile phone by our Website. Cookies can be used to make websites function more efficiently, among other purposes.

 

Receptiviti uses cookies to improve the Website and Services by:

  • helping Receptiviti understand audience sizes and usage patterns on the Website;

  • allowing Receptiviti to tailor the Website to your preferences and interests; and

  • recognizing you when you visit the Website multiple times.

You can turn off cookies using your internet browser but doing so may limit or remove certain parts of the Website, certain content on the Website, or the functionality of the Website.

 

USING AND DISCLOSING PERSONAL INFORMATION

Receptiviti uses and shares your Personal Information, as described below, to:

  • provide you with content, services, or products on or though the Website or Services;

  • customize, measure, and improve the Website or Services, or otherwise analyze or manage Receptiviti’s business operations or Website or Services performance;

  • fulfil our contractual obligations to you as set out in our Terms of Use or API Agreement;

  • prevent prohibited or illegal activities, loss, or fraud, enforce Receptiviti’s Terms of Use or API Agreement, or otherwise protect the security or integrity of the Website or Services or Receptiviti’s business;

  • deliver targeted marketing, service update notices, or promotional offers base on your communication preferences and with your consent;

  • register you for, or authenticate you when you sign into, an account or online services or when you purchase a product or service, or to provide you with notices about such accounts, subscriptions, or purchases; 

  • provide you notice about changes to the Website or Services, this Privacy Policy, or Receptiviti’s Terms of Use or API Agreement;

  • otherwise fulfill the purposes for which you have provided Personal Information or that were described when such Personal Information was collected; or

  • carry out other purposes that are disclosed to you and to which you consent, or which are otherwise permitted or required by law.

Receptiviti will only process your Personal Information with your express consent or to perform a contract with you.   

Receptiviti may disclose your Personal Information if necessary to enforce this Privacy Policy or Receptiviti’s Terms of Use or API Agreement, or if the disclosure is necessary to protect the rights, property, or safety of Receptiviti, the Services, users of the Services, or third parties. Receptiviti may also disclose your Personal Information where we have reason to believe that such Personal Information is relevant to the investigation or decision to investigate a breach of the laws of Canada, a province or territory of Canada, or a foreign jurisdiction, and Receptiviti is legally permitted or required to do so, or to otherwise comply with any court order, law, or legal process, including in response to any government or regulatory request or process, in accordance with applicable law.

Receptiviti may transfer information about you, including Personal Information, in connection with a merger or sale (including any transfers made as part of an insolvency of bankruptcy proceedings) involving all or part of Receptiviti’s business or as part of a corporate reorganization or stock sale or other changes in corporate control.

PERSONAL INFORMATION OF MINORS

Receptiviti is an enterprise solution. The Website and Services are not targeted at, marketed to or relevant for any person who is not the legal age of majority under applicable law. Receptiviti does not knowingly collect Personal Information from any person who is not the legal age of majority under applicable law. 

INTERNATIONAL DATA TRANSFERS

Receptiviti may transfer your Personal Information to third parties that assist Receptiviti in performing its business operations. Some third parties may be located outside of Canada and accordingly may be subject to laws that are different from those in Canada. Receptiviti stores data in the United States. Data transfers outside Canada and the European Economic Area are subject to appropriate legal transfer mechanisms, including the European Commission’s Standard Contractual Clauses. 

Receptiviti contractually binds all processors that receive any Personal Information from us to use the Personal Information only as instructed by us and to apply the same standards as Receptiviti in using, maintaining, disclosing, and protecting such Personal Information. 

YOUR LEGAL RIGHTS 

Subject to certain limitations, you may have the following legal rights to your Personal Information:

  1. Right to be informed: You may have the right to be provided with clear, transparent and accessible information about your rights and how we use your process Personal Information.

  2. Right of access: You may have the right to be provided with a copy of your process Personal Information held by us. If you wish to access the information we hold about you, please contact us at privacy@receptiviti.com.

  3. Right to rectification: You may have the right to request the rectification of your process Personal Information. You can request that we rectify any errors in information that we hold by contacting us at privacy@receptiviti.com.

  4. Right of erasure: You may have the right to request the deletion or removal of certain of the process Personal Information that we hold about you. You can request that we delete or remove certain information that we hold by contacting us at privacy@receptiviti.com.

  5. Right to restrict processing: You may have the right to request that we restrict the processing of your process Personal Information. You can request that we restrict the processing of your process Personal Information by contacting us at privacy@receptiviti.com.

  6. Right to object to certain processing: You may have the right to object to certain processing of your process Personal Information, including the right to object to marketing, and request that your process Personal Information be moved to a third-party. You can object by changing your marketing and email preferences, disabling cookies as set out above. You can also request certain changes to our data processing by contacting us a privacy@receptiviti.com.

  7. Right to data portability: You may have the right to obtain your process Personal Information in an accessible and transferable format so that you can re-use it for your own purposes with other service providers. This is not a general right however and there are exceptions. You can request that we provide you the data we hold on you by contacting us at privacy@receptiviti.com.

  8. Right to withdraw consent: Where we rely on your consent to process Personal Information, you may have the right to withdraw or decline your consent at any time and where we rely on legitimate interests, you have the right to object. Withdrawing consent will not however make unlawful our use of your information while consent had been apparent. You have the right to lodge a complaint about the way we handle or process your information with the national data protection authority. For more information about your rights or to lodge a complaint, please visit the data protection authority in your jurisdiction. 

 

SECURITY OF YOUR PERSONAL INFORMATION

Receptiviti protects your Personal Information by maintaining a strict data deletion process and by tokenizing and de-identifying as much Personal Information as possible. We maintain appropriate physical, organizational, and technological safeguards against unauthorized access, unauthorized disclosure, theft, or misuse appropriate to the sensitivity of such Personal Information. Personal Information collected by Receptiviti may only be accessed by persons within Receptiviti who require access to provide you with access to, use of, or content, services, or products provided on or through the Website or the Services. The Personal Information Receptiviti collects is maintained is maintained in Canada and the United States. Although Receptiviti takes precautions against breaches of or unauthorized access to your Personal Information, no company can fully eliminate the risks of such breaches or unauthorized access and no website, application, or platform is completely secure. Receptiviti cannot guarantee that unauthorized access, hacking, data loss, or breaches of Receptiviti’s security systems will never occur. Accordingly, you should not transmit Personal Information to Receptiviti by any means if you consider that Personal Information to be sensitive.

API data security

Data that is submitted by you for analysis by the API is not stored or saved by the API. Submitted data temporarily exists in RAM during the analysis process and is discarded immediately and automatically once analysis is complete. Data you submit to the API is never saved to persistent storage or logged. Word count metadata is retained solely for the purpose of tracking your account usage of the API. All requests to the API are encrypted between the user and Receptiviti's infrastructure using TLS encryption. For account metadata, objects are encrypted using server-side encryption with either Amazon S3-managed keys (SSE-S3) or customer master keys (CMKs) stored in AWS Key Management Service (AWS KMS).

DATA RETENTION

Except as otherwise permitted or required by applicable law or regulation, Receptiviti retains Personal Information that it collects only as long as necessary for the purposes for which such Personal Information was collected. Receptiviti reserves the right to use anonymized information for any legitimate business purpose without further notice to you and without your consent.

 

THIRD PARTY LINKS

The Website and Services may include, integrate, or rely on links, plug-ins, services, social networks, content, or applications of third parties. Your access or use of such links, plug-ins, services, social networks, content, or applications may allow the third-party provider to collect or share information about you, some of which may be Personal Information. Receptiviti does not control such third-parties’ use of cookies or similar technologies – if you would like to know more about how these third parties use such technologies, you should contact the responsible provider directly. Receptiviti does not accept any responsibility or liability for the privacy policies of any such third-parties or their compliance or non-compliance with such privacy policies.

 

CHANGES TO THE PRIVACY POLICY  

Receptiviti reserves the right to amend this Privacy Policy for any or no reason, at any time, and from time to time in accordance with the terms of this Privacy Policy. Receptiviti will reflect any such amendments on the Website. Your continued access to or use of the Website or Services after any such amendment constitutes your acceptance of the Privacy Policy as then amended. Receptiviti includes the date this Privacy Policy was last amended at the top of this page.
